The Lloyd’s Market Association (LMA) has published a new report examining how artificial intelligence (AI) can impact the international errors and omissions (E&O) market. The report, produced by the LMA’s International Professional Indemnity Committee, explores both the opportunities and risks presented by the rapid adoption of generative AI (GenAI) across professional services sectors. |
GenAI, which includes technologies such as ChatGPT and Google Gemini, is increasingly being used by lawyers, accountants and architects to automate tasks, improve accuracy and reduce costs. However, the report cautions that reliance on AI also introduces new exposures, including liability for errors, data protection breaches and regulatory challenges. The report provides practical guidance for underwriters, including example questions to assess AI-related exposures and considerations for policy wording. It also highlights the importance of fair presentation of risk and ongoing dialogue with the insured. Chris Mather, Senior Executive, Technical Underwriting at the LMA, said: “AI is transforming the way professional services firms operate, but it’s essential that underwriters understand the nuances of these new risks. “Our report highlights the need for clear policy wordings and careful consideration of how GenAI is used within insured firms. Underwriters must ask the right questions to assess risk fairly and ensure coverage reflects the realities of AI-driven workflows.” James McPartland, Chair of the LMA’s International Professional Indemnity Committee and Class Underwriter at Dale Underwriting Partners, commented: “As the adoption of GenAI accelerates, E&O underwriters must understand how these technologies are integrated into day-to-day operations of professional services companies and ensure that coverage is fit for purpose.
