Kate Smith, Head of Pensions at Aegon comments on the government’s proposal to make directors personally liable for unsolicited calls with fines up to £500,000

 “In the UK people are bombarded with unsolicited and unwelcome calls, texts and emails both from home and abroad. These include pension cold-calling and attempts to part people with their hard-earned pension savings. 

 “The new proposals to make directors personally responsible for unsolicited nuisance calls with fines up to £500,000 is another deterrent to help stamp out this annoying feature of the 21st century. Making directors personally liable, rather than fining the business, will stop directors phoenixing where they declare themselves bankrupt to avoid the fine, then pop up later under a different company name. Therefore avoiding the fine and simply carrying on making unsolicited calls as before.

 “People will still need to be on their guard as the new rules won’t apply to businesses making unsolicited calls from abroad. As the rules are strengthened in the UK, the concern is that cold-calling businesses will move offshore so that they are beyond the reach of the UK law.”
